1.4. “Polaris Group” means all companies connected with us. A company is connected with us if it is: (i) a subsidiary or holding company or us; (ii) controlled by the same person(s) who control us or our holding company; (iii) a subsidiary or holding company of any company in (i) or (ii) above; (iv) in the same group as any company under (i), (ii) and (iii) above. “subsidiary” and “holding company” shall be as defined in section 1159 of the Companies Act 2006. “control” shall have the same meaning as defined in Section 416 of the Income and Corporation Taxes Act 1988.

16. Terms of Business
16.1. Recruitment: Each temp assignment or perm placement arising as a result of an introduction made by Polaris will be subject to our standard terms as applicable in the circumstances
16.2. All prospective employers and clients for whom we arrange assignments or placements will be provided with a copy of the Terms of Business applicable to them on first dealing and/or on introduction
16.3. For the avoidance of doubt, separate Terms and Conditions govern the relationship between Polaris and Clients (Terms of Business for the Introduction of Staff), Polaris and Candidates (Candidate Terms), temp assignments (Contract for the Supply of Temp Worker Services) and the use of our timesheet system, (TMS, Terms & Conditions).
17. Safeguarding, Compliance Checks & Employment Regulations
17.1. Polaris is committed to safeguarding and promoting the welfare of children and young people and expects all staff, candidates and clients to share this commitment.
Some roles that Polaris introduce candidates to may involve work with under 18’s or vulnerable adults. Any appointment to such roles will be made subject to strict vetting and screening compliance checks and receipt of a satisfactory enhanced DBS check.
17.2. Polaris acts as an Employment Agency (perm) and an Employment Business (temp)
17.3. Polaris must comply with requirements set out in the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (as amended from time to time) (the Conduct Regulations) and the Employment Agencies Act 1973 (the "Act"). No breaches of the Conduct Regulations and the Act will be tolerated by Polaris.
18. Governing Law & Jurisdiction
18.1. The use of the Website and any agreements entered into through the Website are to be governed by and construed in accordance with English law. The courts of England are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of the Website or any agreement made through the Website.
18.2. Some of the goods or services offered through the Website may not be lawful or may otherwise not be permitted in certain countries outside the United Kingdom.
